BOMBA SAFARIS TERMS AND CONDITIONS

The following terms and conditions (“Terms and Conditions”) apply to all services and products under Bomba Safaris Oy (”Bomba Safaris”) which refer to guided tours and equipment rental ordered by the customer (“Customer”). To ensure smooth arrangements, these Terms and Conditions are always adhered unless otherwise agreed in writing.

Reservation confirmation and binding force

The following Terms and Conditions are adhered when the Customer has received a reservation confirmation. At this point a contract for the provision of services under the agreed terms is formed between Bomba Safaris and the Customer. The reservation confirmation includes reservation details, reservation terms and prices. Changes to the booking must be made in writing or by phone to our sales service or directly to Bomba Safaris in accordance with the cancellation and modification terms specified below.

Reservation specification

We request that you send us the detailed itinerary of the reservation and the following information at least two (2) weeks before the arrival date if it is a group reservation:

  • Names and contact details of the group leader / event organizers

  • Any special dietary requirements

  • Event program and schedule

Transfer of agreement

The Customer does not have the right to transfer the contract or to assign the rented equipment to a third party without the written consent of Bomba Safaris.

General cancellation terms

Cancellations and changes to reservations can be made without any fees from the most recently confirmed number of people as follows, according to the original size of the reservation:

The terms and costs for cancellation of events for more than 350 people are agreed on a case-by-case basis and if Bomba Safaris so requires. If no other terms are applicable, reservations for more than 350 people will be subject to the same terms as reservations for 201–350 participants.

We recommend travel insurance that also covers costs arising from trip cancellation.

Terms and conditions of cancellation

In the event of cancellation, the cancellation costs are calculated as presented in the tables above. If the number of participants in the reservation exceeds the original reservation, the Customer agrees to the cancellation terms for a larger reservation. If a participant arrives later or leaves before the agreed time or fails to arrive entirely, Bomba Safaris will charge the full amount. Bomba Safaris has the right to full compensation for all services and products ordered in advance. This also applies to services ordered through subcontracting. The reservation’s price is determined according to the confirmed number of participants. If the actual number of participants is greater than the confirmed number, the price is determined according to the actual number.

For cancellations of purchases made through the online store, we charge an office fee of 6,90 € per reservation.

Payment terms

Reservations made online and on-site are paid for at the time of order with a payment card or exercise benefits. Exercise benefits can only be selected as a payment method in connection with sports services. It is not accepted as payment for physical products. We accept the following exercise benefits: SMARTUM, EPASSI, and EDENRED. All of the above-mentioned exercise benefits can also be used to pay for sports services directly in our online store.

For pre-booked group reservations, a group invoice is always issued. It is necessary to agree on the invoice separately in advance. The customer is responsible for all group costs unless otherwise agreed in writing. The payment method is an advance invoice, invoicing (if a valid invoicing agreement exists), or payment card, unless otherwise specifically agreed. Invoicing is subject to the currently valid invoicing surcharge, charged per invoice. All rights to changes are reserved. Bomba Safaris has the right to issue an advance invoice for the whole reservation or part of it to the Customer. If the Customer does not pay the advance invoice by the due date, Bomba Safaris has the right to cancel the entire reservation.

Order change / Force majeure

At any time, Bomba Safaris may interrupt or cancel a reservation if it interferes with other activities or if it endangers the reputation of Bomba Safaris or the safety of its other customers.

Each party has the right to cancel or change a confirmed reservation due to force majeure without any liability. Force majeure shall be deemed to be a circumstance beyond the control of the party which occurs after the confirmation of the reservation and as a result of which fulfilling the agreement becomes unlawful or excessively difficult and which the party could not reasonably have taken into account when concluding the agreement. Such an event may be strike, war, mutiny, internal unrest, requisitioning for public need by public authorities, import or export prohibition, natural disaster, interruption of public transport, public telecommunications or energy distribution, industry-wide labour conflict or fire, epidemic, pandemic or another unusual event that has significant effects and that is beyond the control of the party. After the obstacle appears, the party who wishes to invoke force majeure must immediately notify the other party in writing about postponing the fulfilment of its contractual obligations, same as of its termination.

Prices

All prices are quoted in euros and include VAT. Bomba Safaris reserves the right for price changes if they are based on changes in legislation or public charges imposed by the authorities arising after the confirmation or during the possible agreement period agreed with the Customer. The Customer will be notified of such changes separately. We also reserve the right to price changes if the reservation changes (date(s), duration of reservation and/or number of people). Prices do not include any fees charged by the travel agent, unless otherwise stated in the confirmation.

The Customer’s responsibilities

The Customer is responsible for the accuracy of the information provided. The Customer is obliged to handle the rental equipment carefully, ensuring it is not damaged or lost. No markings may be made on the rental equipment, and no parts may be removed or detached. It is the Customer’s responsibility to report any deficiencies or faults found at the time of equipment handover. If the equipment requires repairs, the Customer must bring them to Bomba Safaris for repair. The Customer rents and uses the rental equipment at their own risk and must ensure their own valid insurance coverage.

The Customer is responsible for any damages caused by the Customer’s devices, staff, performers, or participants to Bomba Safaris' equipment or other movable property. The Customer is responsible for the devices and movable property they bring to the excursion. The Customer and service users are committed to following the instructions given by Bomba Safaris' staff regarding the use of Bomba Safaris' services and equipment, as well as safety instructions. The Customer is solely responsible for the reservation as a whole. Equipment rental does not include guided tour-like guidance.

Service users must follow the traffic rules and laws of Finland, both on excursions and when renting equipment. Participants commit to using necessary accessories for the rental equipment (e.g., life jackets, helmets, etc.). Participation in excursions and the rental and use of equipment are prohibited while under the influence of alcohol.

The Customer is responsible for ensuring that the services or equipment rental are suitable for the users. The guardian of a minor child is responsible for the child's suitability for renting equipment and participating in excursions.

Bomba Safaris responsibilities and rights

Bomba Safaris is responsible for ensuring that the guided tours and equipment rental are as agreed, taking into account what has been stated in these Terms and Conditions regarding service changes.

Bomba Safaris ensures that the rental equipment meets the requirements set by legislation.

Bomba Safaris has the right to cancel or modify a reservation or terminate the contract if Bomba Safaris’ staff assesses that the service user is not suitable for the guided tour or equipment rental.

Verifying Customer’s Identity

The Customer is obligated to prove their identity when requested.

Use of the rental equipment

Upon accepting the rental agreement, the Customer is granted the right to use the rental equipment during the times specified in the contract. The Customer may not transfer the rental equipment to a third party. Any subleasing will be agreed upon on a case-by-case basis.

Procedures in cases of equipment faults, damage and theft

The Customer is obligated to promptly report any loss, destruction, or damage to Bomba Safaris' equipment, and/or faults occurring in the equipment. In cases of theft, the Customer must report the incident to the staff of Bomba Safaris.

Customer’s liability for compensation

The Customer is obliged to compensate for any damage resulting from the loss or damage of the rental equipment unless they can demonstrate that they have taken proper care of the equipment. The Customer is required to pay the repair costs for any broken damage and any other additional expenses.

Bomba Safaris must inform the Customer of any damage that is observable during an external inspection of the equipment at the time of its return or promptly after Bomba Safaris has discovered the damage.

The Customer is not liable for compensation for the normal wear and tear of the equipment.

Returning of rental equipment

The equipment must be returned by the end of the rental period. If the Customer wishes to extend the rental period, this must be agreed with Bomba Safaris before the end of the current rental period.

If the Customer returns the rental equipment late or fails to return it at all, Bomba Safaris may charge additional rent until the equipment is returned or found.

If the Customer returns the rental equipment early, they are not entitled to a monetary refund. However, in the event of an unforeseeable circumstance affecting the Customer, it is possible to transfer the unused rental period to a later time, according to an agreement.

Liability for damage caused to the Customer or a third party

By accepting the rental agreement, the Customer confirms that they are aware of the risks associated with the relevant activity and the use of the rented equipment.

The Customer is liable for any damages incurred to Bomba Safaris or a third party if caused by their own actions.

The Customer is responsible for ensuring that the rented equipment is suitable for the intended use.

Otherwise, the Customer is responsible for any damage caused to themselves or a third party in accordance with the prevailing principles of liability for damages.

Special arrangements

If the reservation requires special permits, decorations, or devices that deviate from the norm, the Customer commits to covering the resulting costs. Special arrangements will be agreed upon in writing separately between the parties.

Photographing at Bomba Safaris’ services

If you intend to take photographs during the excursion or equipment rental, please note that photography and the publication of images may only occur with the consent of the individuals appearing in the photos.

Termination of Bomba Safaris operations

If the ownership of Bomba Safaris Oy is transferred outside of the S-group or if the company ceases operations ("Termination Date"), this agreement will terminate on the part of Bomba Safaris Oy. On the Termination Date, all contractual obligations cease on the part of Bomba Safaris Oy. In the above-mentioned case, Bomba Safaris Oy will strive to provide an alternative service of a comparable standard to Bomba Safaris Oy under the terms agreed upon in this agreement. Bomba Safaris Oy will promptly inform the Subscriber in writing about the matter.

Changes to the services and to the Terms and Conditions

Bomba Safaris reserves the right to make changes to the guided tours and to rental services. Bomba Safaris aims to inform the Customer about the changes in advance.

Bomba Safaris can change these Terms and Conditions at any time without further notice.

Applicable law and settlement of disputes

These Terms and Conditions are governed by Finnish law, excluding its provisions on the choice of international law. Disputes arising from or related to this reservation between the parties will primarily be resolved through mutual settlement negotiations between the parties. Disputes arising from the agreement that cannot be resolved between the parties will be settled in the district court of Bomba Safaris Oy's domicile as the first instance.
